Child Sex Abuse Inquiry – vexatious ban on release of information

Ben Bradshaw MP Posted on Mon, March 09, 2015 12:23:08

Email sent – 07 March 2015 06:47

Dear Mr Bradshaw

Please see the attached letter from Lady Goddard’s Secretariat for the forthcoming Child Sex Abuse Inquiry. As you are aware, I am on record that the ICO and the DCC are part of a wider conspiracy to pervert the course of justice and cover up of child sex abuse via willful use of section 14(1) of the FOIA 2000, Vexatious Exemptions and in particular the Dransfield v ICO case ref GIA/3037/2011. As you are aware, this case is currently awaiting a Court of Appeal decision under ref C3/2013/1855.

For some inexplicable reason you have refused categorically to meet me at your Friday night surgery to discuss this and other issues which leaves a very bad taste in my mouth…..

My only redress against your consistent failures and inaction is to boycott you at the next general election.

Yours sincerely

Alan M Dransfield.

Independent Panel Inquiry into Child Sex Abuse
The Inquiry Secretariat, C/O 2 Marsham St, London, SW1P 4DF

Dear Sirs

I acknowledge and thank you for your attached letter. I wish to make two important corrections to your letter.

1. It was not my FOIA request.

2. I have not received any response from the ICO on this topic. Why would I because I did not send a FOI request?

Such errors by your panel does not instil me with the greatest of confidence that a thorough investigation into child abuse will take place.

I fully agree with you that it is of the “utmost importance” that children and young people are kept safe from all forms of abuse. However, to achieve this, there must be unfettered access to public records and I fervently do believe the ICO are complicit with the Police and other 3rd Parties to obstruct the FOIA 2000. In particular, the unlawful use of Section 14(1) Vexatious Exemptions as prescribed in the GIA/3037/2011 Dransfield v ICO, ref C3/2013/1855 currently before the Court of Appeal. I fervently do not believe that section 14(1) vexatious exemption can be used as a fair minded exemption and especially not in this sex scandal case.

Transparency, accountability and security must be seen to be working at the ICO to allow public access to sex scandal legal documents and at this Juncture it is not seen to be working. On the contrary, records at the ICO support my claims the ICO are complicit with others to cover up child Sex abuse.

I reiterate my offer to present myself as a witness to the Independent Panel to give evidence on this matter in the interest of justice.

For your information,action and files

With thanks

Was Lafarge Cement used on the Dawlish Sea Wall?

Ben Bradshaw MP Posted on Mon, March 09, 2015 12:19:37

Email sent – 08 March 2015 07:01

Dear Mr Bradshaw

It is most disconcerting (but not surprising) that new cracks have been
identified in the Dawlish Sea Wall.

No doubt the SW rail link will be closed down for another 12 months to
enable repair works.

May I suggest you ask Network Rail to produce a copy of their As Built
Health and Safety Files for the recently completed works, and we might be able
to identify the exact problem.

I strongly recommend you also enquire if any Lafarge Cement was used on the
Dawlish Sea Wall in the last 10 years.

The next time you are in Exeter, would it be possible for you and I to
cycle to Dalwish and check this wall out but only if you promise to wear a helmet.

For your information, action and files.

Yours sincerely

Alan M Dransfield

More problems at the Dawlish Sea Wall

Ben Bradshaw MP Posted on Mon, March 09, 2015 12:11:41

Dear Mr Bradshaw

As you are aware, I have copied you in on a number of health and safety issues during the
Dawlish Sea Wall (DSW) repair programme last year, and it comes as no surprise
to me the BBC have reported yet further serious structural cracks in the DSW – quelle surprise.

As you can see I have made FOIA requests to the Office of Rail Regulator
(ORR) which were ignored.

I call upon my MP to seek a public inquiry into the DSA repair programme
and I am absolutely astonished to learn the that Network Rail conduct a monthly inspection of the DSW defence. Under the circumstance of the previous cowboy builders and negligence of NR and ORR, these inspections need to be carried out
on a daily basis.

Network Rail cannot continue these miracle escapes eg London tunnel collapse, the previous DSW collapse. It is only a matter of time before a packed
commuter train runs of of track

It might be possibly thought that both NR and ORR are complicit and covering up serious health and safefy issues on the DSW and nationwide.

With thanks

Yours sincerely

Overflash Lightning Strikes

Lightning Protection Posted on Mon, March 09, 2015 12:02:18

Email sent – 09 March 2015 07:06

Dear Mr Bradshaw

I have reason to believe the Devon County Council may possibly have fraudulently
approved the Sports Ground Safety Certificate (SGSC) for the Exeter Chiefs
Rugby Stadium. It is an offence for a public authority to issue a Sports Ground
Safety Licence if they know the said stadium is unsafe.

As you are aware, a SGSC must be produced by the Local Authority for any
sports stadium with a capacity of 10,000 people or more.

A simple ocular inspection of the Exeter Chiefs Rugby Stadium will confirm
the Stadium is unsafe and unfit for purpose owing to numerous health and safety violations which include but not limited to:-

1. Failure to provide Lightning Protection Systems in accordance with the
BS/EN 62305/2008 on original stadium and recent upgraded stadium. Applicable to all parts of the ground. The biggest danger related to
Lightning is overflash strikes, which have not been
considered at design or construction phase.

2. Various trip hazards at ground level.

3. Various protruding and sharp objects from stadium fixings.

4. Earthing and grounding failures.

5. Inadequate toilet and washing facilities.

As you are aware, the adjacent pedestrian Bbidge is subject to a Court of
Appeal ruling.

May I suggest you write to the DCC and the Rugby Club on this matter. You
might wish to ask the Sports Ground Stadium Authority why they appear to have
ignored this particular stadium.

As you are aware, the Exeter Chiefs Rugby Stadium is scheduled to be used
later this year for the Rugby World Cup. The worst case scenario (WCS) at both the pedestrian bridge and the stadium is multiple deaths or serious injuries
from lightning overflash.

WCS was not considered at either design or construction phase of this
stadium.

For your information, action and files.

With thanks

Yours sincerely

New West Ham Stadium

Lightning Protection Posted on Mon, March 09, 2015 11:57:38

Email sent – 09 March 2015 08:04

Attn Karen Brady
CEO West Ham Football Club

Dear Karen

I hold serious concerns for your fans safety when they move into the new
Queen Elizabeth Stadium. In particular, I do not believe the new stadium has been
provisioned with adequate Lightning Protection System Safety (LPSS) as
prescribed in law via BS-EN 62305-2008.

The oversight authorities for this stadium have failed to provide me with
the necessary proof that your stadium has been provisioned with adequate
LPSS.

The Balfour Beatty Group has been responsible for the design and build of
this stadium, and they have a long history of Lightning Protection Failures
Nationwide.

I can recommend an independent lightning protection specialist from the US
who will confirm your new sports stadium is non-compliant to the relevant lightning protection standards as aforementioned.

For you information and files

Yours sincerely

Alan M Dransfield.

No Transparency at What Do They Know Charity

WhatDoTheyKnow Ban Posted on Mon, March 09, 2015 11:55:00

Email sent – 09 March 2015 08:29

Dear Mr Bradshaw

As you are aware, the Whatdotheyknow (WDTK) are a charity receiving
government funding, therefore, they must ensure transparency, accountability and
security of their capital funding.

As you are aware, I have been placed on a lifetime ban by the WDTK……

I request my MP to write
to the appropriate oversight authorities on this matter please.

with thanks

Yours sincerely

Shockingly vexatious and unreasonable requests – not!

Devon County Council Posted on Mon, February 23, 2015 20:37:35

Email sent – 23 February 2015 06:47

Dear Mr Bradshaw

In the event the Court of Appeal rule against me in the subject title, I intend to appeal to the Supreme Court or the ECHR and I am now preparing my skeleton argument.

As you are aware the Information Commissioner’s Office & Devon County Council legal argument is solely reliant on the context and history of my FOIA requests.

Please see the DCC list of their vexatious or manifestly unreasonable exemptions/refusals. This list contains 55 of my FOIA requests between 11/4/11/ and 7/3/12.

Each and every one of my FOIA requests in this letter is straightforward and benign and holds serious purpose and public interest. Not one single request from the attached list is either vexatious or manifestly unreasonable. On the contrary, they have been made in the interest of health and safety issues concerning the general public and in the interest of the public purse.

There is no doubt in my mind that it is the DCC and the ICO who have been vexatious not me.

I invite my MP to read each of my 55 FOIA requests and then advise me if you think my requests are either vexatious or manifestly unreasonable. I appreciate your view must be face value but as MP for Exeter, you do have first hand knowledge of a couple of items namely:

1. Millions of tonnes of contaminated cement were sold to the West Country in 2005 from Lafarge Cement Company. Both the DCC and the ICO claim it was a batch of contaminated cement, which is hogwash. It was a batch of cement all right which contained over a million tonnes of the stuff which the DCC and City Council turned a blind eye to.

2. St Peters NEW PFI school was provided with bottled water for 6/7 years because the drinking water was contaminated.

Would it be possible to book an appointment at your Friday night Surgery to discuss these FOIA requests please?

With thanks

Yours sincerely.

Alan M Dransfield

By the way, it is now approx 11/12 years since the contaminated cement was raised in the first instance by myself and I would envisage that we will now start to encounter serious structural failures/ collapses of Buildings and Structures which contains hundreds of tonnes of contaminated cement (including the 6 PFI schools), which will no doubt be further cost to the public purse. As a long standing MP of Exeter you have first hand knowledge of such dangers but have chosen to ignore them.
