The complainant submitted a request to the Cabinet Office for a copy of
the then Minister for the Cabinet Office/Chancellor of the Duchy of
Lancaster, Michael Gove’s, ministerial diary for the period 1 March 2020
to 16 April 2020. The Cabinet Office refused the request on the basis of
section 14(1) (vexatious) of FOIA given the burden of complying with it.

  1. The Commissioner’s decision is that the Cabinet Office is entitled to rely
    on section 14(1) of FOIA to refuse to comply with the request.
  2. No steps are required.

The complainant has requested a copy of the ministerial diary of the Rt
Hon Matt Hancock MP during a 17 month period when Mr Hancock was
Secretary of State for Health. The Department of Health and Social Care
(“the DHSC”) relied on section 14(1) of FOIA (vexatious) to refuse the
request on the grounds that complying would impose a grossly
oppressive burden.
