I wish to draw your attention to the subject title and I consider the ICO are now using Section 12/4b of the EIR in the same manner as they are using section 14/1 of the FOIA 2000.
As recently as last week the ICO are using my case GIA/3037/2011 as a Court Authority whilst the GIA case is STILL live. Please see recent ICO attached decision.
This is contrary to Stare Decisis and Common Law. It also drives a Bus through Common Sense.
The ICO are willfuly and flagrantly using Section 12/b of the EIR and section 14/1 of the FOIA as tools to circumvent BOTH acts.
In a nutshell the ICO are using both Acts to circumvent the Acts and in particular sect 77 of the FOIA 2000.
I would be most grateful if you would bring this matter to the attention of your line manager please.
